In my experience as a personal injury attorney, practicing in Polk County, FL, I represent victims of automobile accidents. As the attorney, it is my role to look at the client's case from all angles. It is important to note that Florida law permits a defendant in a negligence case to raise a comparative negligence defense. If successful, the plaintiff's award may be reduced by the percentage of the plaintiff's own negligence. When the accident victim is a minor child, one should further look to the parent or adult who was responsible for the victim at the time of the accident. The comparative negligence defense may be raised if there is a question of inadequate supervision.
